Telecom Consumer Rights: How to Fight TRAI-Violating Practices by Jio, Airtel & Vi

India has over 1.2 billion mobile subscribers — and telecom operators know most of them won't fight back. TRAI has given you powerful rights. Here's how to use them.

Your Key Rights as a Telecom Consumer

  • Quality of Service: TRAI mandates minimum call quality and data speed standards. Persistent poor service is a legitimate grievance.
  • Transparency: All tariff plans must be clearly disclosed. Hidden charges or mid-plan modifications without notice are illegal.
  • Do Not Disturb (DND): Telcos must register your DND preference within 24 hours and enforce it. Spam calls after DND registration are a TRAI violation.
  • Number Portability: You have the right to port to any network within 7 days. Operators cannot block or delay MNP without valid reason.
  • SIM Security: Operators must verify your identity before any SIM-related changes. Unauthorised SIM swap is their liability.
  • Refund on prepaid: Unused validity refunds apply if you port out.

Most Common Telecom Violations in India

1. Forced Plan Upgrades

Operators discontinued lower-priced plans in 2024, forcing subscribers to higher-cost options. While operators can change tariffs with 7 days' notice, they cannot migrate you without explicit consent. If migrated without consent, file immediately.

2. Unexplained Data Exhaustion

Data balance depleting faster than usage justifies. This can be due to background app activity, but if you can prove it matches the network pattern, operators must investigate and may credit data.

3. Spam Calls Despite DND

TRAI fines telcos ₹500 per violation after the first spam call on a DND-registered number. File systematically — each call is a separate violation.

4. SIM Swap / Port Fraud

Fraudsters convince your operator to issue a new SIM on your number, gaining access to OTPs. If this happens, the operator is liable for not verifying identity properly.

5. Poor Network Quality (4G/5G Claims vs Reality)

Operators charging for 5G plans but providing 3G speeds in your area. TRAI mandates minimum speed benchmarks — operators must deliver or face penalties.

6. Roaming Charges Without Notice

Being charged for roaming without clear notification, or in areas the operator claimed had free roaming as part of the plan.

Step-by-Step: How to File a Telecom Complaint

Step 1 — Complain to the Operator's Grievance Cell

Call customer care and ask to escalate to the Grievance Redressal Officer (GRO). Get a complaint number. Operators must resolve within:

  • Network/connectivity issues: 3 days
  • Billing disputes: 7 days
  • SIM-related issues: immediate escalation

Step 2 — Escalate to the Nodal Officer

If unresolved within the timeline, escalate to the Telecom company's Nodal Officer. Contact details are mandated to be on the company's website under "Grievance Redressal."

  • Airtel Nodal: airtel.in/help
  • Vi Nodal: myvi.in/help
  • BSNL: 1800 345 1500

Step 3 — File with TRAI/DOT Sanchar Saathi

Visit sancharsaathi.gov.in — the government's telecom consumer portal. Report:

  • Suspected fraudulent SIMs in your name
  • Spam calls (after DND registration)
  • Disconnection without notice
  • MNP rejection

Also use the TRAI MyCall app to report network quality issues with automatic GPS-tagged evidence.

Step 4 — File at TDSAT (Telecom Disputes Settlement Appellate Tribunal)

For unresolved billing or service disputes above ₹1,000, file at tdsat.gov.in. TDSAT is specifically empowered to adjudicate consumer-vs-telecom disputes. Filing fee is nominal (₹1,000). No lawyer needed for individual consumers.

Step 5 — Consumer Forum

For compensation beyond what TDSAT awards (mental harassment, consequential losses like bank fraud due to SIM swap), file at your District Consumer Forum simultaneously.

⚠️ SIM Swap Emergency: If your SIM suddenly stops working, call your operator's fraud hotline immediately (Jio: 1800 889 9999, Airtel: 121). A dead SIM can mean a SIM swap attack — someone may be intercepting your OTPs right now. Get your number blocked within minutes.

DND: Register and Enforce It

  • SMS "START 0" to 1909 to block all commercial calls/SMS
  • SMS "START DND" for partial blocks by category
  • Download TRAI DND app to report violations directly with call logs as evidence
  • Each verified spam call on a registered DND number = ₹500 fine to the sender + ₹10 to you as complainant
